    Re: ADA Complaint DJ# 204-48-221

Dear Ms. Schwebel:

I am pleased to enclose a copy of a Settlement Agreement between the Department and the Borough of Red Bank that became effective October 30, 2002. It is designed to resolve the ADA issues that you brought to our attention by filing your complaint. As you can see, the Borough of Red Bank has agreed to remove barriers to accessibility in seven of the Borough's owned and operated facilities, to provide effective communication, including appropriate auxiliary aids and services, and to implement a grievance procedure provided by the Department. The Department also required the Borough to publish a notice stating that it will not discriminate against persons with disabilities and that it will provide auxiliary aids and services to members of the public who are deaf or hard of hearing. After we monitor the Agreement for three years to ensure that its terms are frilfilled, your complaint file will be closed.

We would like to thank you for triggering a review of the Borough of Red Bank, which has led to greater equal opportunity for persons with disabilities in the area of program accessibility. Please do not hesitate to contact me if you have questions about the Agreement or if you have additional ADA matters to bring to the Department's attention. I can be reached by phone at (202) 347-3160, by fax at (202) 347-5053, or via email at natalie.sinicrope@usdoj.gov.

Sincerely,
